NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Homestead.
REQUEST FOR RELEASE OF FUNDS
On or about December 20, 2024, the City of Homestead will submit a request to the State of Florida, Department of Commerce for the release of Community Development Block Grant-Disaster Recovery Infrastructure Repair Program (CDBG-DR) funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project known as Avocado Villas Potable Water System Improvements for the purpose of replacing existing water mains within the Avocado Villas neighborhood. The proposed project is anticipated to cost $4,708,599, of which, $4,519,000.00 is to be sourced from CDBG-DR funds and $189,599 from local City of Homestead funds. The proposed project area is generally bounded by SW 192nd Avenue to the west, West Mowry Drive to the north, SW 189th Avenue to the east, and SW 328th Street to the south in Homestead, Florida.
FINDING OF NO SIGNIFICANT IMPACT
The City of Homestead has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at City of Homestead Public Works and Engineering, 551 SE 8th Street, Homestead, Florida, 33030 and may be examined or copied weekdays 9 A.M to 4 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to Mr. Eduardo Gonzalez, Assistant Director of Public Works & Engineering, at 551 SE 8th Street, Homestead, Florida, 33030, and 305-224-4786. All comments received by December 19, 2024, will be considered by the City of Homestead prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The City of Homestead certifies to State of Florida, Department of Commerce that Dr. Nzeribe Ihekwaba, PE, in his capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Commerce’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Homestead to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
Commerce will accept objections to its release of fund and the City of Homestead’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Homestead; (b) the City of Homestead has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by Commerce; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the State of Florida, Department of Commerce, Office of Long-Term Resiliency at Caldwell Building, MSC-400, 107 East Madison Street, Tallahassee, Florida 32399-6508. Potential objectors should contact Commerce to verify the actual last day of the objection period.

Estos avisos satisfacen dos requisitos procesales distintos pero relacionados para actividades que llevará a cabo la Ciudad de Homestead.
SOLICITUD PARA LIBERACIÓN DE FONDOS
En o cerca del 20 de diciembre 2024, la Ciudad de Homestead procederá a someter una solicitud al Estado de Florida, Departamento de Comercio (Comercio) para la liberación de fondos del Programa de Reparación de Infraestructura de Recuperación de Desastres (CDBG-DR) bajo el Título I de la Ley de Vivienda y Desarrollo Comunitario (HCD) de 1974, según enmendada, para llevar a cabo el proyecto conocido como Avocado Villas Water Main Replacement con el propósito de reemplazar las tuberías de agua existentes dentro del vecindario de Avocado Villas. Se anticipa que el proyecto propuesto costará $4,708,599, de los cuales, $4,519,000.00 provendrán de fondos CDBG-DR. El área del proyecto propuesto generalmente está delimitada por SW 192nd Avenue al oeste, West Mowry Drive al norte, SW 189th Avenue al este y SW 328th Street al sur en Homestead, Florida.
DETERMINACIÓN DE NO IMPACTO SIGNIFICATIVO
La ciudad de Homestead ha determinado que el proyecto no tendrá impacto significativo en el ambiente humano. Por lo tanto, no es necesaria una Declaración de Impacto Ambiental bajo la Ley de Política Ambiental Nacional del 1969 (NEPA, por sus siglas en inglés). Un Expediente de Revisión Ambiental (ERR, por sus siglas en inglés) que contiene información adicional del proyecto está disponible en Ciudad de Homestead Obras Públicas e Ingeniería, 551 SE 8th Street, Homestead, Florida, 33030, y puede ser examinado o reproducido en días laborables de 9 a.m. a 4 p.m.
COMENTARIOS PÚBLICOS
Cualquier individuo, grupo o agencia puede proveer comentarios por escrito acerca del ERR al Sr. Eduardo González, Subdirector de Obras Públicas e Ingeniería, en la 551 SE 8th Street, Homestead, Florida, 33030 y 305-224-4786. Todo comentario recibido hasta el 19 de diciembre de 2024 será considerado por la Ciudad de Homestead antes de autorizar que se someta la solicitud de liberación de fondos. Los comentarios deben indicar a cuál aviso en específico responden.
CERTIFICACIÓN AMBIENTAL
La Ciudad de Homestead certifica al Estado de Florida, Departamento de Comercio y HUD que el Dr. Nzeribe Ihekwaba, PE, en su capacidad como de administrador de la ciudad, da su consentimiento a aceptar la jurisdicción de las cortes federales si una acción legal fuera iniciada para hacer cumplir responsabilidades relacionadas al proceso de revisión ambiental y que estas responsabilidades se satisfagan. La aprobación por parte de Comercio de la certificación satisface sus responsabilidades bajo NEPA, y las leyes y autoridades relacionadas, y permite que la Ciudad de Homestead utilice fondos del Programa.
OBJECIONES A LA LIBERACIÓN DE FONDOS
Comercio aceptará objeciones a su liberación de fondos y la certificación por parte de la Ciudad de Homestead por un período de quince días a partir de la fecha anticipada de recibo o la fecha en que en efecto se reciba la solicitud de liberación de fondos (lo que ocurra más tarde) solamente si estas se basan en una de las siguientes posibles razones: (a) la certificación no fue firmada por el Oficial Certificador de la Ciudad de Homestead; (b) la Ciudad de Homestead omitió un paso o no tomó una decisión o determinación que es requisito de la reglamentación de HUD en 24 CFR Parte 58; (c) el beneficiario de la subvención u otros participantes en el proceso de desarrollo comprometieron fondos, incurrieron en gastos, o llevaron a cabo actividades no autorizadas por 24 CFR Parte 58 antes de que Comercio apruebe la liberación de fondos; o (d) otra agencia federal actuando de acuerdo con 40 CFR Parte 1504 sometió una determinación de que el proyecto no es satisfactorio desde el punto de vista de calidad ambiental. Las objeciones deben prepararse y someterse de acuerdo con los requisitos procesales (24 CFR Parte 58, Sección 58.76) y dirigirse al Departamento de Oportunidades Económicas de Florida, Oficina de Resiliencia a Largo Plazo en Caldwell Building, MSC-400, 107 East Madison Street, Tallahassee, Florida 32399. Objetores potenciales deben contactar a Comercio para verificar la fecha en que en efecto finaliza el período para objeciones.
